This is a legal agreement between you, either an individual or an entity, (“Customer”), and Canada Web Developer (“Canada Web Developer”)
By purchasing this service you, you agree to all of these terms and consent to the transmission of certain information. If you do not accept and comply with these terms, you should avoid purchasing the service.
1. GRANT OF LICENSE.
(a) Canada Web Developer grants Customer a limited, non-exclusive, non-assignable nontransferable, royalty-free license to showcase, demonstrate or other wise use the Software Code, Images and other digital materials supplied by Canada Web Developer (“Website”) on any server computer device in a production environment that the Customer has access to.
All other rights are reserved to Canada Web Developer. Customer shall not rent, lease, sell, sublicense, assign, or otherwise transfer the Website and any accompanying printed or digital materials.
Customer may not reverse engineer, decompile or disassemble the Website except to the extent that this restriction is expressly prohibited by applicable law. Canada Web Developer and its suppliers shall retain title and all ownership rights to the Website, and this Agreement shall not be construed in any manner as transferring any rights of ownership or license to the Website or to the features or information therein, except as specifically stated herein.
(b) Customer agrees to provide at the bottom of the Website a link, button, image or any other digital object as well as feedback, including but not limited to usability, bug reports and test results, with respect to the testing of the Website. Customer will use reasonable efforts to review and comment on all bug reports, test results and other feedback made by Customer shall be the property of Canada Web Developer and may be used by Canada Web Developer for any purpose it sees fit. Due to the nature of the development work, Canada Web Developer is not certain if errors or discrepancies in the Website may be corrected.
2. TERM OF AGREEMENT.
The term of this Agreement shall commence on Customer’s purchase of the Website Product and shall continue until terminated by Canada Web Developer, with or without cause. Upon the termination of this Agreement, Customer shall promptly return to Canada Web Developer and certify destruction of, all full or partial copies of the Website and related materials provided by Canada Web Developer.
3. COST OF THE WEBSITE.
The Customer agrees to pay the total amount of $164.30 to Canada Web Developer for Canada Web Developer to assign a development server and team for the Customer, if the Customer decides to ask for a physical copy of the Website then the Customer shall bear all transportation expenses relating to the shipment of the Website to Customer’s place of business. If Customer returns the Website, Customer will pay the return transportation expenses.
4. SUPPORT MAINTENANCE.
Canada Web Developer is not obligated to provide maintenance, updates, technical or other support for the Website after 30 natural days after the Website has been installed by Canada Web Developer on the Customer’s Production Server Device. Canada Web Developer may use such information for its business purposes, including for product support and development. Canada Web Developer will not utilize such technical information in a form that personally identifies Customer. Such limited Support Services may not be available in all countries. In no event shall Canada Web Developer be obligated to provide Customer, free of charge, support or maintenance services for the Website.
5. REFUND AND SUPPORT POLICY
All Sales Are Final, Canada Web Developer does not issue refunds, support services or warranty of any kind, either expressed or implied for any of the services we offer.
Unfortunately, the nature of the work we do for our customers cannot be guaranteed due to the extent of improper hosting configurations, software bugs, user mistakes or misuses and/or other factors.
The Customer agrees that has read the refund and support policy and without pressure or outside intervention the Customer voluntary revokes its legal rights to request, ask or demand for refunds and support services.
6. ENTIRE AGREEMENT.
This Agreement constitutes the complete and exclusive agreement between Canada Web Developer and Customer with respect to the subject matter hereof, and supersedes all prior oral or written understandings, communications or agreements not specifically incorporated herein. This Agreement may not be modified except in a writing duly signed by an authorized representative of Canada Web Developer and Customer.
